1. Supplier, scope, and agreement

These Terms govern the Trader Thabza website, paid educational content, downloadable materials, and communities operated by Deguru Pty Ltd, trading as Trader Thabza ("we", "us", or "our"). "You" means the person purchasing or using these services. Supplier contact information is set out below.

Purchase terms apply when they are presented to you before you place an order and you accept them. Review and save these Terms and the offer shown at checkout. If you do not accept them, do not complete a purchase. Any rights that applicable law does not allow you to waive remain yours.

The specific product description and order confirmation establish the purchased features, delivery arrangements, price, and access period. A specific written promise made for your purchase is not cancelled by a general disclaimer here. These Terms apply alongside the relevant Whop platform and payment terms; they do not replace them.

2. Eligibility and account security

Paid course access is intended for adults aged 18 or older who can lawfully enter into a contract. You must provide accurate registration and purchase details, comply with restrictions applicable in your location, and use only payment methods you are authorised to use.

Your licence is for one named learner. Keep your login details secure, do not share accounts or sell access, and notify us promptly if you suspect unauthorised use. You remain responsible for activity you authorise. We do not make you responsible for losses caused by our own security failures where the law makes us liable.

3. Education only; no personalised financial advice

The service provides general trading education. Lessons, charts, commentary, examples, and community discussions are not personalised recommendations to buy, sell, hold, or invest in any instrument. They do not account for your finances, objectives, experience, or risk tolerance and do not establish an advisory, fiduciary, brokerage, or investment-management relationship.

We do not accept trading deposits, manage your trading account, execute trades for you, or promise funded-account approval as part of this course. You make your own trading and broker decisions. If you need individual advice, consult an appropriately authorised professional.

An educational label does not change the legal character of a service that is actually provided. Nothing here claims regulatory authorisation or exempts either party from applicable financial-services law.

4. Trading risk and no guarantee of profits

Trading foreign exchange, CFDs, and other leveraged products carries substantial risk. You may lose the money committed to trading; depending on the product, provider, and applicable protections, losses may exceed an initial deposit. Leverage can magnify losses as well as gains. Execution, liquidity, spreads, fees, slippage, and market events may affect outcomes.

We do not guarantee profits, income, a win rate, a particular return, recovery of losses, financial independence, or success within any period. Course fees pay for educational access, not a promised trading outcome. A successful example or another person’s result does not predict your result.

Historical charts, demonstrations, backtests, simulated trades, and hypothetical results have limitations. They may benefit from hindsight and may not reflect live execution, costs, or the ability to follow a strategy under pressure. Past performance is not a guarantee of future performance.

You are responsible for deciding whether to trade, how much risk to take, and whether a product is suitable for you. Your trading losses or failure to achieve an expected result do not, by themselves, create a contractual refund entitlement. This does not remove remedies for misleading claims or other supplier misconduct.

5. What you purchase and how access works

Access is granted after successful payment and any required account checks. The offer and confirmation identify the access period. Access is not lifetime access unless that is expressly stated in the purchased offer. Expiry ends your entitlement to the restricted service; permitted downloads remain subject to the content licence.

Only features expressly included in your purchased offer are included. Private mentoring, live calls, trade signals, future courses, software, and individual support are not included merely because they appear elsewhere on the website or in community discussions.

We may correct errors, reorganise lessons, and update examples while preserving the essential scope of your purchased service. If we cannot deliver a material paid feature or discontinue paid access before the agreed end date, we will provide the remedy required by law and any applicable refund or cancellation rights. We will not use an update to retrospectively reduce rights already agreed.

You need a compatible device, an internet connection, and access to the delivery platform. Report an access fault with your order details so that it can be investigated. Temporary maintenance or third-party outages do not automatically create a refund entitlement, but prolonged failures and non-delivery remain subject to applicable remedies.

6. Prices, payments, renewals, and cancellation

Review the currency, total price, taxes, billing frequency, and access duration at checkout before paying. Any instalment commitment or automatic renewal must be disclosed there. We do not create an undisclosed recurring subscription through these Terms.

If your selected plan renews, manage cancellation through your Whop account using the instructions for that plan. Cancellation of a renewal normally stops future renewals; it does not automatically reverse a payment for an elapsed period. Any statutory right to cancel a fixed-term agreement and any limits on cancellation charges continue to apply.

Whop provides the checkout and payment service; Trader Thabza supplies the course. Whop’s applicable terms govern its payment services. We may suspend unpaid access after a failed payment while the issue is resolved. Cancelling a card, withholding payment, or losing account access does not itself resolve a valid instalment obligation, subject to lawful cancellation rights.

7. Refund policy and mandatory exceptions

No discretionary refunds: to the extent permitted by applicable law, digital course purchases are final. We do not offer a voluntary money-back guarantee or change-of-mind refund because you no longer want the course, have not used it, lack time to study, disagree with the teaching style, or do not achieve your expected trading results. A specific refund promise shown with your purchased offer will be honoured.

This policy does not exclude mandatory cooling-off, withdrawal, cancellation, quality, non-delivery, misrepresentation, or other consumer rights. It does not prevent correction of duplicate or erroneous charges, or remedies required by Whop, a card network, a regulator, or a court.

Starting access does not automatically waive statutory rights. Where the law permits early digital delivery to affect a withdrawal right, the required express consent and acknowledgement must be obtained before delivery. These Terms alone do not supply that consent or acknowledgement.

If South African law applies, applicable rights under the Consumer Protection Act and Electronic Communications and Transactions Act remain in force. An electronic-transaction cooling-off right may apply, subject to statutory exceptions. For consumers elsewhere, any mandatory local rights are preserved.

Contact the supplier through the seller contact details on your Whop receipt, or the support contact below, with your order reference and the reason for your request. Requests will be considered under the applicable law and purchased offer. Approved or required refunds are returned through the appropriate payment process within applicable deadlines. A refund that ends the purchase also ends the associated access licence.

8. Payment disputes and chargebacks

If you believe a charge is incorrect or the service was not supplied, contact us so we can investigate. You may also use Whop’s support processes. We may provide accurate purchase, delivery, access, and correspondence records to the payment provider to respond to a dispute.

Nothing here prevents a genuine chargeback, statutory complaint, or other lawful remedy, and contacting us first is not a condition of exercising a legal right. Deliberately false claims, forged evidence, and fraudulent payment activity are prohibited. We will not impose an automatic chargeback penalty or retaliate against a good-faith complaint.

9. Content ownership and personal-use licence

Original course videos, lesson text, worksheets, diagrams, recordings, branding, and other protected materials belong to us or their respective licensors. Buying access does not transfer ownership or give you a right to reproduce or sell the materials. Third-party materials remain owned by their rights holders.

During your agreed access period, you receive a limited, personal, non-exclusive, non-transferable licence to view the course for your own learning. You may download only items for which we expressly provide a download option and use those items privately under this licence.

Except with written permission or where applicable law expressly permits it, you must not share credentials; distribute, resell, publish, upload, or publicly display course materials; record restricted lessons; remove watermarks; bypass access controls; scrape the service; or incorporate protected materials into another course, commercial service, dataset, or AI-training collection.

The licence does not prevent you from applying what you learn in your own practice, creating your own original notes, or exercising lawful copyright exceptions. It protects our expression and materials, not ownership of public facts or general trading ideas.

We may investigate suspected infringement, request removal of unauthorised copies, suspend affected access, and pursue remedies available under law. Any damages or recovery of costs must be legally justified; these Terms do not create an arbitrary per-copy penalty.

10. Community conduct and submissions

Community members must be respectful and must not harass others, post unlawful or discriminatory content, impersonate staff, solicit trading funds, run scams, distribute restricted lessons, or advertise unrelated products without permission. Do not post private financial records, credentials, or another person’s confidential information.

Free Telegram access is separate from the paid course. Membership does not promise personal responses, trade alerts, investment recommendations, or continuous availability. Member posts are their own views and are not verified recommendations from us. We may moderate content and restrict accounts for breaches of these rules.

You retain ownership of content you submit. You grant us only the permission reasonably necessary to host, display, and moderate it within the service where you submitted it. We will seek separate permission before using your name, likeness, testimonial, or results in advertising. Submit only content you are entitled to share.

11. Suspension and termination

We may proportionately restrict access for non-payment, account sharing, fraud, serious misconduct, or infringement. Where practicable, we will explain the reason and give you an opportunity to respond or correct a remediable breach. Immediate restriction may be necessary to stop an ongoing security incident, unlawful conduct, or distribution of protected content.

A justified restriction for your material breach does not automatically entitle you to a discretionary refund. Mandatory remedies remain available. If we end paid access for our convenience without your breach, we will provide an appropriate refund for the unprovided service or another remedy you agree to, subject to applicable law.

Content restrictions, outstanding lawful payment obligations, and provisions intended to operate after termination continue for as long as lawfully applicable.

12. Third-party platforms and links

Whop, Telegram, video hosts, charting tools, brokers, and other external services operate under their own terms and privacy notices. A link is not a guarantee of their reliability or an endorsement of every product they offer. We do not control their outages, execution, fees, or account decisions.

This distinction does not excuse our own obligations to supply the service you purchased. Any affiliate relationship or material commercial incentive will be disclosed where relevant.

13. Service standards and limits of liability

We will perform our obligations with the care and skill required by applicable law. Educational information may contain errors or become outdated, and we do not warrant that every example is suitable for a particular person or that uninterrupted access is always possible. Statutory service standards and specific promises made at purchase are preserved.

To the extent a fair and lawful limitation is permitted, we are not liable for speculative profits, lost trading opportunities, or indirect or consequential loss arising from your independent trading decisions. For other claims where a contractual cap is lawful, our aggregate liability relating to the affected paid service is limited to the amount you paid for that service.

The exclusions and cap do not apply to fraud, wilful misconduct, gross negligence, death or personal injury where exclusion is unlawful, mandatory refunds, liability for our own infringement, or any liability that applicable law does not permit us to exclude or limit. They do not remove rights to fair terms, lawful remedies, or regulatory protection.

You are responsible for consequences of your own unlawful use or infringement. We may seek proven, legally recoverable loss caused by that conduct; you do not indemnify us for our own wrongdoing or negligence merely by using the service.

14. Personal information and records

Information needed to fulfil orders, provide access, respond to support requests, protect accounts, and handle disputes will be processed in accordance with applicable data-protection law. Payment and account platforms also process information under their own privacy notices.

These Terms do not substitute for a complete privacy notice or authorise unrestricted marketing, sharing, or retention of your information. Requests concerning your personal information may be sent to the supplier contact below. Records used to handle payment disputes must be relevant and lawfully handled.

15. Changes, outside events, and general provisions

We may revise these Terms for future purchases and ongoing use. Material changes affecting an existing paid service will be notified in advance where required and will not retrospectively remove accrued rights, create new charges, or reduce the essential purchased service without lawful grounds or your agreement. The applicable version and specific offer should be retained with your order.

Events outside reasonable control may delay performance. We will take reasonable steps to reduce the impact and inform affected customers. Such events do not excuse obligations indefinitely or remove cancellation and refund rights for undelivered services.

If a provision is unenforceable, it will apply only to the extent lawfully permissible or be severed while the remaining lawful provisions continue. A failure to enforce a term on one occasion is not a permanent waiver. We may not transfer a contract in a way that unlawfully reduces your rights.

16. Applicable law and resolving complaints

These Terms are governed by the laws of South Africa, subject to mandatory consumer protections and jurisdiction rights that apply in your location. No clause here requires you to waive access to a competent court, consumer regulator, ombud, or payment-dispute process, or imposes compulsory arbitration.

Send complaints with your order reference and a clear description of the issue using the supplier contact below or the seller contact on your receipt. We will investigate in good faith. Attempting an informal resolution does not restrict a legal deadline or your right to seek a remedy.
